Now, he has been diagnosed with a tumor in his head and needs immediate surgery to remove it before it's too late.

Santa Ana City Jail has a record of abuses of gay and transgender detainees, delays in medical care, and reports of mistreatment. Sergio needs to be released immediately!

The Petition

To Sen. Feinstein, Sen. Boxer, Rep. Becerra, Rep. Lofgren, Assistant Secretary of Homeland Security, John Morton, and Secretary of Homeland Security, Janet Napolitano:

I am writing to call for the immediate release of Sergio Vazquez Gutierrez (A# 200-243-222) from the Santa Ana City Jail and urge that you take immediate action to stop his deportation.

On July 2011, Sergio was arrested after his neighbors called the police because Sergio and his partner were arguing. He was then transferred to a detention center, where he spent a month before being released. On May 2012, Sergio was detained by ICE and has since been held at the Santa Ana City Jail.

Sergio came to the United States from Mexico in search of a better life. He's been living in California for the past 8 years. Living in the U.S. meant a fresh start for him, where he hoped to not be ignored or mistreated for being gay. Sergio was disowned by his family when he came out as gay. Sergio is now 42 years-old, is currently living with AIDS, and before being detained he was diagnosed with cancer. Doctors have recommended he start chemo treatment immediately but for the past five months that he’s been in the Santa Ana City Jail, he has NOT received the medical treatment he needs. Sergio has now been diagnosed with a tumor in his head and needs immediate surgery to remove it before it’s too late.

Santa Ana City Jail has a record of abuses of gay and transgender detainees, delays in medical care, and reports of mistreatment. In 2011, the United Nations charged that ICE had violated provisions of the U.N.'s Convention Against Torture regarding the abuse of more than a dozen gay and transgender detainees held in detention centers across the US. One of those centers was the Santa Ana City Jail. Sergio’s health is deteriorating in detention because he is being denied the medical attention he needs. This goes against claims from ICE that they can detain gay immigrants like Sergio in a safe and humane way.

According to the memo issued by John Morton, Sergio is not a priority for deportation and, due to the tumor in his head, he should be released immediately to be able to receive the medical treatment he needs in order to survive. Sergio will not receive adequate AIDS treatment in Mexico, and the time to remove the tumor in his head is running out. Furthermore, Sergio must be released to he can begin to receive chemo treatment.

I urge you to release Sergio Vazquez Gutierrez from the Santa Ana City Jail immediately and stop his deportation.
